Contract
Bonjour Travel Tours To France, LLC
(hereinafter Bonjour Travel), located at 8854 Tallow Road, St-Joseph,
Minnesota 56374, in return for full payment by you of the amount specified, is
responsible to arrange for the transportation (if full packages are
selected), accommodations and other services specified as included on this
website as and to the extent you have selected them, and subject to the
following terms and conditions. Unless
expressly specified as included by this website, services, taxes and fees are
not included.
Responsibility: Bonjour Travel is
responsible to you for arranging all included transportation, accommodations
and other services. However, in the
absence of negligence on its part, Bonjour Travel is not responsible for
personal injury, property damage, or any other loss, claim or damage arising
out of or related to goods or services
offered or included. Bonjour Travel is not responsible for personal injury,
property damage or any other loss, claim or damage related to or arising out
of, in whole or in part, the acts of omissions of any direct air carrier,
hotel, ground operator, or other person not its direct employee or not under
its exclusive control supplying any services or providing any goods offered
or included. Bonjour Travel is not
responsible for personal injury, property damage or any other loss, claim or
damage arising out of, either in whole or part, acts of God, weather, labor
strife, government actions, mechanical breakdowns, war-like acts, terrorist
activities or other causes reasonably beyond the control of Bonjour
Travel. Bonjour Travel is not
responsible for incidental or consequential losses or damages.
Payment: A
deposit in the amount shown on the reservation form and a signed contract for
each person is required to secure reservations. Final payment is due as shown
on the reservation form. If the flight
is fully booked, your payment will be returned, or with your authorization,
your name placed on a waiting list. All checks and money orders are to be made
payable as indicated on the reservation form.
Confirmation is subject to receipt by Bonjour travel of both deposit
and signed contract.
Prices: Bonjour Travel reserves the right to increase
prices in the event of a fuel related surcharge imposed by the airlines or if
the dollar falls below the one to one ratio (one euro for one dollar). Bonjour Travel reserves the right, if
necessary or advisable, to substitute air carriers, but is not obliged to do
so.
Baggage: Bonjour Travel
cannot be held responsible for luggage lost or damaged. You should give immediate notice to the
involved air carrier, hotel, ground operator and to
your own insurance company.
Aircraft boarding: This flight will be
performed using a U.S. certified air
carrier. The air carrier reserves the right to substitute equipment but is
not obliged to do so. Bonjour Travel
cannot be held responsible for airline delays.
Aircraft boarding privileges are limited to
persons whose full payment and signed contract have been received by Bonjour
Travel and whose names are on the manifest given to the air carrier prior to
departure. All travelers must provide
proof of identity and a passport valid for travel from the Unites states to
the international destinations served prior to boarding. Improper travel documentation, inadequate
proof of identity, inadequate proof of age for children appearing under 2, or
any other reason may result in denial of boarding privileges. The air carrier reserves the right to
decline, accept or retain any person on the flight at any time within their
sole discretion. If you are denied
boarding privileges, you forfeit all monies paid and will be assessed any
non-recoverable costs.
Insurance: Trip cancellation,
health and accident insurance is available and may
protect you against unforeseen circumstances which cause you to interrupt or
cancel your trip.
Changes: Except for circumstances that make it
impossible to perform, Bonjour Travel cannot cancel within 10 days of
departure date.
If cancelled by Bonjour Travel, and you have
paid deposits and are holding confirmed reservations at the time of
cancellation, you are entitled to a full refund of all monies paid.
If we make major changes prior to departure
you have the right to cancel and receive a full refund. The following are major changes: 1) a
change in departure or return date, unless the change results from a flight
delay experienced by the carrier (if the delay is longer than 48 hours, it
will be considered a major change; 2) a change in the origin or destination
city, unless the change affects only the order in which cities named are
visited, 3) a price increase of more than 10 percent occurring 10 or more day
days before departure. In no event can
we increase your price less than 10 days before departure.
If a major change must be made, we will
notify you within seven days after first learning of the change, but in any
event at least 10 days prior to the scheduled departure. If less than 10 days before departure we
become aware that a major change must be made, we will notify you as soon as
possible. Within 7 days after
receiving notification of a major change but in no event later than departure
on the initial flight, you may cancel your reservation and you will receive a
full refund within 14 days after cancellation. If a major change occurs after the
departure of the initial flight which you are unwilling to accept, you will
be refunded, within 14 days after your scheduled return date, that portion of
your payment which applies to the services not accepted.
If we must cancel we will notify you in
writing within seven days of the cancellation, but in no event later than ten
days before the scheduled departure date of the initial flight. We have no right to cancel less than 10
days before departure, except for circumstances that make it impossible to
perform. If that occurs, you will be
notified as soon as possible but not later than the scheduled departure
date. In such an event, a full refund
will be made to you within 14 days after cancellation.
The rights and remedies relating to
cancellations and major changes prior to departure, made available under this
contract are in addition to any other rights or remedies available under applicable
law. However, we offer any refunds
under this contract with the express understanding that the receipt of that
refund by you waives all other remedies.
If you
change plans or cancel, your rights to a refund are limited: Check with us for
details, each tour has its individual deadlines with airlines and
hotels. If you find a substitute, you
will receive a nearly full refund- the airline will assess a $150 name change
fee.
Bonjour Travel has no obligation to find a
substitute. If we have travelers on
our waiting list, we’ll let you know as soon as you contact us. Any request of cancellation must be
communicated in writing. Applicable
refunds, if any, will be made 14 days after the cancellation or substitution.
There are no exceptions of any kind,
including medical exceptions, to these policies. No refund will be made for any portion of
the arrangements we have made for you that are not actually utilized by you. There is no variance from these policies
for the services we arrange as described in this website.
